As you probably know, under FAR Part 120, an individual who performs a safety-sensitive function, either directly or by contract, for an FAR Part 121 or Part 135 air carrier or an operator conducting nonstop passenger-carrying flights under FAR § 91.147, is subject to drug-and-alcohol testing. Performing aircraft maintenance or preventative maintenance duties are both considered safety-sensitive functions.

In-flight Internet (IFI) access has gained traction over the past decade, with advancements facilitated by the expansion of ground- and satellite-based broadband communication capabilities. Each of these technologies pushes the other in appealing to service providers and airlines/operators, which, in turn, will benefit the flying public for years to come.

In the last issue of D.O.M., we discussed maintenance industry concerns over the availability of instructions for continued airworthiness (ICA). The article centered upon the FAA regulations requiring that ICA be provided, and summarized the FAA’s recent efforts to remove barriers on ICA distribution through impermissible restrictions (policy statement PS-AIR-21.50-01). This month, we again look at FAA regulations surrounding ICA and examine issues arising for maintenance providers as a result of inadequate or unavailable information.

Distributors of Concorde batteries recently received a surprising letter explaining the rationale behind its decision to halt the manufacturing of its CB battery product line. Concorde manufactures “RG Series” batteries which are valve-regulated lead acid (VRLA) batteries, also known as sealed recombinant batteries. VRLAs have become widely accepted in aviation. The CB battery is from Concorde’s flooded lead acid battery product line.

Overall, 2012 was a fair year for the aviation industry. The large aircraft manufacturers and their operators were busy. Yet, medium and small aircraft manufacturers and their operators were not as prosperous. In some cases, aviation companies continue to struggle from the economic downturn of 2009. In all cases, I’m very optimistic of 2013 for the aviation industry.

In what the Aeronautical Repair Station Association (ARSA) is calling a major victory for the aviation industry, on December 26, 2012, the Federal Aviation Administration (FAA) withdrew its faulty legal interpretation of maintenance duty time limitations prescribed in Title 14 Code of Federal Regulations (14 CFR) section 121.377.

In March, at HELI-EXPO 2013 in Las Vegas, Helicopter Association International (HAI) will premiere a new safety education initiative called the HAI Rotor Safety Challenge. This program, developed in coordination with the FAA Safety Team and the HAI Safety Committee, will include safety events, forums, and education sessions, conveniently scheduled on show days March 5 through 6. The program will include sessions created specifically for maintenance professionals.

Avgroup announces that Jim Spencer will open a new office location for Avgroup in Wichita, KS. Spencer will focus on customers in the northwestern U.S. and in Canada. Spencer has more than twenty years of experience with Matrix Aviation and a background in avionics. “We are excited to welcome Jim to the Avgroup team,” said Steve Piller, Avgroup president. “His avionics background and knowledge of the region will add a new dimension to our strong sales team.”

Brian Schank and Darwin Stout now head the respective sales teams for principally the east and west coasts of the United States. They report to Mike West, vice president, Product Support Sales.

West Star Aviation recently announced the availability of the enhanced flight vision system (EFVS) known as Hud vision access (HVA) for the Challenger 604 and Challenger 605 aircraft. Certification of the system is expected January 2013. The HVA system consists of three LRUs and provides numerous benefits to the operator, including safer operation in low visibility, enhanced situation awareness, terrain avoidance and runway incursion detection.

Aviation Fabricators (AvFab) announces the launch of the mobile version of its Web site. The new site was specifically developed to allow users a new level of access to AvFab’s King Air capabilities and products from a smart phone or tablet. “We recognize that more and more of our customers are getting their product information and making purchases on their phones,” says Jeffery Lowe, AvFab vice president. “Now people can access details of our products from their mobile devices in a format that is quick and easy to use.”

The National Business Aviation Association (NBAA) congratulates members of Congress upon House passage of a bipartisan measure (S.1956) that would prohibit U.S.-based aircraft operators from participating in the European Union Emissions Trading Scheme (EU-ETS). The House previously approved a similar bill last year. The measure, titled “The European Union Emissions Trading Scheme Prohibition Act,” was sponsored in the Senate by Sens. John Thune (R-SD) and Claire McCaskill (D-MO); it now awaits President Obama’s signature.
